As registration is necessary for ODMS Cloud and thus for the performance of a contract to which the data subject is a party, the legal basis for processing is necessity for the performance of a contract to which the data subject is party.
If you provide information to us, we will use your information to administer your product registrations and link them to your account. Likewise, processing of Personal Data may be necessary for performance on the basis of the user agreement for ODMS Cloud. This also applies to processing operations that are necessary to carry out pre-contractual measures.
Sound data uploaded to ODMS Cloud may be processed for the purpose of converting it into text data through a sub-processor. We will delete the original sound data promptly after completing the transcription process and will not retain the data thereafter.
Beyond that, we may process Personal Data and information you enter for the purpose of utilizing ODMS Cloud.
We will only contact you with electronic messages in relation to the service that are not promotional in nature.
3 To whom do we transfer your data?
Personal Data collected from you will be processed primarily in Ireland. However, OMDS is part of a large international group of companies. It may be necessary for the operation of ODMS Cloud to grant access to your data to the our group company mentioned below and our service providers, some of which are located in countries that may not recognized by the European Commission or Information Commissioner's Office as providing an adequate level of data protection. Although data protection and other laws of other countries may not be as comprehensive as those in your country of residence, we take steps to ensure that your privacy is protected. We transfer Personal Data to these countries only when we have been able to implement suitable safeguards that ensure the protection of your Personal Data. For further information, including the process for obtaining a copy of the documents used to protect your Personal Data, please contact us at data-protection@om-digitalsolutions.com.
In particular, in connection with the voice-to-text transcription function provided by ODMS Cloud, sound data uploaded by Users may be temporarily transferred to and processed by a sub-processor located in Japan for the purpose of converting the sound data into text data. The sub-processor acts solely on behalf of User and OMDS and does not retain the original sound data after the conversion process is completed.
The resulting text data will be stored on servers located in Ireland. Based on instructions given by the User within ODMS Cloud, such text data may be made available to User and secretaries or typists designated by the User for the purpose of checking and editing the transcription.
By using our services, you must be aware that your information can be accessed from our facilities as described by this Privacy Notice.
We may transfer your Personal Data, when necessary, to the following company within our company group, and the following company participates in the program and provides services in conjunction with us as necessary.
We may transfer Personal Data to Dealers who must have this information to make it possible to provide the agreed service and who are required to maintain this information under this Privacy Notice. None of these companies will process the data for any purpose other than managing ODMS Cloud.

Please note that once you close an account, you will no longer be able to log in and will therefore not have direct access to the Personal Data. To assert your rights, please refer to Section 10.
The Personal Data will be deleted without undue delay when processing is no longer necessary for the stated purposes.
Sound data uploaded to ODMS Cloud for voice-to-text transcription will be processed for the purpose of transcription and deleted promptly after the conversion process is completed. The resulting text data will be stored on servers located in Ireland, for as long as necessary to provide the ODMS Cloud services and fulfill contractual obligations, and will be deleted without undue delay when no longer necessary.
Storage may be prolonged when mandated by European, national or other legislation to which we are subject. The Personal Data will also be deleted if a storage period prescribed by such legislation expires, unless further storage of the Personal Data is necessary for the conclusion or performance of a contract.
5 Cookies and other technologies
The ODMS Cloud website only uses session cookies for the ODMS Cloud. Session cookies allow website operators to link a User's actions during a browser session. A browser session begins when a User opens the browser window and ends when the User closes the browser window. Session cookies are created temporarily. Once you close the browser, all session cookies are deleted. Other than that, OMDS does not use cookies or similar technologies to track visitors to this website.
6 How we protect your personal data
We are committed to protecting the Personal Data we collect. We have implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk. For example, only authorized employees may access Personal Data, and only in the context of authorized business functions. In addition, we use encryption when we transfer your sensitive personal data between your system and ours. Dictations can be recorded in DSS Pro format with 256-bit AES encryption. Sound data uploaded to ODMS Cloud for voice-to-text transcription will be processed for the purpose of transcription and deleted promptly after the conversion process is completed. The resulting text data will be stored on servers located in Ireland, for as long as necessary to provide the ODMS Cloud services and fulfill contractual obligations, and will be deleted without undue delay when no longer necessary.
5 Cookies and other technologies
The ODMS Cloud website only uses session cookies for the ODMS Cloud. Session cookies allow website operators to link a User's actions during a browser session. A browser session begins when a User opens the browser window and ends when the User closes the browser window. Session cookies are created temporarily. Once you close the browser, all session cookies are deleted. Other than that, OMDS does not use cookies or similar technologies to track visitors to this website.
6 How we protect your personal data
We are committed to protecting the Personal Data we collect. We have implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk pursuant to the Applicable Laws. For example, only authorized employees may access Personal Data, and only in the context of authorized business functions. In addition, we use encryption when we transfer your sensitive Personal Data between your system and ours. Dictations can be recorded in DSS Pro format with 256-bit AES encryption. We use firewalls to ensure that unauthorized persons do not gain access to your information.
7 Protecting Children’s Privacy
Our websites are directed at a specific audience and we don’t offer services to children. Registration on the website is required and children will not be admitted. When we become aware that a child under the age of 16 has submitted Personal Data to us, we will delete that data immediately.
